In these general terms and conditions the following terms apply: 'Sukrin' Sukrin Benelux BV, located in Roermond (6045 GH), Marie Curieweg 1 B and registered with the Chamber of Commerce under no. 64790479. Our VAT number is NL.188.8.131.52. B01. You can reach us by sending an email to firstname.lastname@example.org "You" The person who by any means enters into an agreement with Sukrin.
2.1 An agreement with us is concluded after you indicated your order with the aid of our order system.
2.2You have the right to cancel the agreement by email within 24 hours after placing the order.
2.3Sukrin is not bound by its offer in the event of printing, typesetting or programming errors in its catalogs, mailings or on the Website.
3.1We reserve the right to withdraw this offer within 48 hours after receiving your order. 3.2 Sukrin is entitled to refuse orders or attach certain conditions to the delivery, unless explicitly stated otherwise. If an order is not accepted, Sukrin will communicate this within ten (10) days after receipt of the order.
4.1Orders placed via the internet site can be paid in the following ways: Post-pay via Klarna, IDeal, Bancontact, CreditCard (Visa, Mastercard and American Express), SEPA Transfer, PayPal (+ € 1 transaction costs), ApplePay, Belfius and KBC / CBC.
4.2In the case that a term of payment is agreed upon by Sukrin, the mere expiry of that term will cause the consumer to be in breach. The standard payment term is 14 days, unless otherwise agreed in writing.
4.3In case paying by credit card is chosen as the preferred payment method, the conditions of the specific card issuer apply. Sukrin is not involved in the relationship between you and the card issuer.
4.4In case of non-timely payment, Sukrin is entitled to terminate the agreement with immediate effect or to suspend (further) delivery up to the point at which you have fully complied with the payment obligations.
5.1 If you are in default with the fulfillment of one or more of your obligations, all reasonable costs incurred by obtaining a settlement out of court will be at your expense. If you fail to pay a sum of money on time, we will impose a fine of 15% on the amount due, starting with a minimum fine of €50,00.
5.2 In case we incurred higher costs and we can demonstrate these costs were reasonably necessary, they will also qualify for reimbursement.
5.3 Any reasonable judicial and enforcement costs incurred are also for your account.
5.4If a cash-on-delivery order is returned to Sukrin because it has not been accepted or collected, the costs of the cash on delivery order and administration costs will be charged to the customer. You can find more information about these costs in the article 5.1
6.1Sukrin applies a maximum delivery time of 30 days. If this delivery time is exceeded, you have the right to cancel your order without the charge of any costs. Exceeding the delivery time does not entitle you to any form of compensation or any other action with respect to Sukrin unless there is intent or deliberate recklessness caused by Sukrin.
6.2 Sukrin reserves the right to deliver products in multiple deliveries. The delivery of the products takes place at the place and time when the products are ready for shipment to your address.
6.3 If you refuse delivery without Sukrin's consent, you must reimburse Sukrin for the expenses or losses caused by that refusal, including storage costs, up to the point at which you accept delivery. (see also article 4)
Only the Dutch law applies to all our offers, agreements and the implementation thereof.
8.1 Sukrin is not liable towards the buyer or third parties regarding direct and consequential damage of any nature whatsoever arising from the agreement or the use of the delivered product, unless there is any intent or gross blame by Sukrin. p>
8.2 With regard to any product liability, Sukrin's liability towards a consumer buyer is limited to the amount that its indemnity insurance pays out in the event of a justified claim.
8.3 In the unlikely event that an event should occur leading to any liability of Sukrin, other than product liability, the liability will be limited to the amount the damage insurance pays out, or at most twice the invoice amount of the products delivered ibeyond the objective of the non-life insurance directives.
9.1 There is a posibility that you are not satisfied with a product and/or service. Please contact us as soon as possible, preferably by email at: email@example.com We will respond to your complaint within 30 days at the latest.
9.2 We will always try to find a suitable solution for you, if we cannot find a solution together, you can submit your complaint to the Thuiswinkel Disputes Committee, PO Box 90600, 2509 LP The Hague, against payment of 25 euros regarding complaint money. For more information about this Disputes Committee, see: www.sgc.nl. This independent committee will decide what to do with the dispute. The decision of this committee is binding. If you are (partially) in the right, then the complaint money will be (partially) refunded to you.
9.3 The foregoing does not affect the right to submit a dispute to the competent court.
You have the right to cancel this contract within 14 days without giving any reason.
The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.
To exercise the right to cancel, you must inform us (Sukrin Benelux B.V., Marie Curieweg 1 B, 6045GH Roermond, firstname.lastname@example.org, phone number: +31 (0) 475 20 11 11) of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model cancellation form, but it is not obligatory. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us). We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. We will make the reimbursement without undue delay, and not later than –
(a) 14 days after the day we receive back from you any goods supplied, or
(b) (if earlier) 14 days after the day you provide evidence that you have returned the goods, or
(c) if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.
We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
You are obliged to carefully inspect the products or have them inspected immediately upon receipt. Complaints from you, which relate to visible defects in the product or delivery, must be reported to Sukrin.
